These Terms and Conditions govern your use of the OfertaSV mobile application, and the services provided through it. By accessing or using our app, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these terms, please do not use the application.

  2. By using the OfertaSV app, you acknowledge that you have read, understood, and agree to abide by these Terms and Conditions. You also acknowledge that you are at least 18 years of age or have obtained parental consent to use this app.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.   2. We reserve the right to terminate or suspend your access to the OfertaSV app at our discretion, without notice, for any reason, including, but not limited to, violation of these Terms and Conditions or engaging in activities that may harm other users or the platform.

To the fullest extent permitted by the laws of El Salvador, OfertaSV and its affiliates, including their respective officers, directors, employees, agents, partners, and licensors, shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses, whether incurred directly or indirectly, or any loss of personal information or financial information, resulting from:

  1. Your use or inability to use the OfertaSV App, including any disruptions, errors, or omissions in the services provided by the App.

  2. Any unauthorized access to or use of our servers and/or any personal information stored therein.

  3. Any interruption or cessation of the App's services, whether due to technical issues, maintenance, updates, or other circumstances.

  4. Any errors or omissions in the content provided on the App, including product listings, descriptions, and pricing information.

  5. Any unauthorized access to or use of any personal information or financial information stored on the App, including but not limited to payment information and user profiles.

  6. You acknowledge and agree that the limitations and exclusions of liability set forth in this section are reasonable and essential elements of these Terms and Conditions, and that without such limitations, OfertaSV would not provide access to the App or its services.

  7. You further acknowledge and agree that any claim or cause of action arising out of or related to your use of the App must be filed within one year after such claim or cause of action arose. Otherwise, such claim or cause of action shall be permanently barred.

  8. In jurisdictions that do not allow the exclusion or limitation of certain warranties or liability for certain types of damages, the above limitations may not apply to you. In such cases, the liability of OfertaSV and its affiliates shall be limited to the maximum extent permitted by applicable law.

  9. OfertaSV does not warrant or make any representations regarding the accuracy, completeness, or reliability of any information, content, or advertisements provided through the App. We do not endorse any products or services advertised or offered by third parties through the App.

  10. You are solely responsible for assessing the accuracy and reliability of any information or content provided through the App, and for making your own decisions regarding any transactions or interactions with other users or third parties.

  11. While we take reasonable measures to secure the App and protect your personal information, you acknowledge that no data transmission or storage system is completely secure, and we cannot guarantee the security of your data.

  12. Governing Law

  13. These Terms and Conditions are governed by and construed in accordance with the laws of El Salvador. Any disputes arising from or related to these terms will be subject to the exclusive jurisdiction of the courts of El Salvador. These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of El Salvador.

  1. Any dispute, claim, or controversy arising from or relating to these Terms and Conditions, including their existence, validity, interpretation, performance, breach, or termination, shall be subject to the exclusive jurisdiction of the courts of El Salvador.

  2. You acknowledge and agree that the choice of El Salvador as the governing law and jurisdiction is reasonable and mutually acceptable. This choice of law and jurisdiction is intended to provide a fair and consistent legal framework for both you and OfertaSV, promoting clarity and predictability in the resolution of any disputes.

  3.  Furthermore, you consent to the personal jurisdiction of the courts located within El Salvador for the resolution of any such disputes, and you waive any objection to the convenience of such forums.

  4.  In the event of a dispute, you agree to first attempt to resolve the matter through good-faith negotiations and mediation before resorting to arbitration or litigation, in accordance with the applicable laws and regulations of El Salvador.

  5. These governing law provisions do not preclude the application of any mandatory consumer protection laws in your jurisdiction that may apply to your use of the OfertaSV App, provided that such laws do not conflict with the terms set forth in these Terms and Conditions.

  6. Dispute Resolution

  7. Any dispute, controversy, or claim arising out of or in connection with these Terms and Conditions shall be resolved through arbitration in accordance with the rules of the El Salvador Chamber of Commerce. The arbitration shall be conducted in the Spanish language.

  2. If you are accessing or using the OfertaSV App from outside El Salvador, you are responsible for complying with all local laws, rules, and regulations in your jurisdiction. OfertaSV does not guarantee that the App complies with the laws and regulations of any other country.

If any provision of these Terms and Conditions is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary to make the remaining provisions enforceable, and the validity and enforceability of the remaining provisions shall not be affected.

  2. The failure of OfertaSV to enforce any right or provision of these Terms and Conditions will not be considered a waiver of those rights. Any waiver of any provision of these Terms and Conditions must be in writing and signed by OfertaSV.

  2. OfertaSV reserves the right to modify or replace these Terms and Conditions at any time. Any changes will be effective immediately upon posting on the app. Your continued use of the app following the posting of any changes constitutes acceptance of those changes.
